What a regulated activity is
Some activities affect health, safety, public order, the environment or other people's money. The State subjects them to prior control: to carry them on, you need an approval, a licence or a permit issued by the competent ministry or body. Trade register registration is not enough.
There is no single, fixed table to check once and for all. Executive Decree No. 15-234 sets the common rules, and each regulated activity refers to its own text (law, decree or order), which names the competent authority and the conditions. The Ministry of Commerce gathers these texts in a collection dedicated to regulated professions and activities.
What the texts say
How to tell whether your activity is regulated
- Find the exact code of your activity in the nomenclature of economic activities, available on Sidjilcom, the CNRC portal.
- Check whether the activity's entry mentions a regulated status or an issuing authority.
- Look for the activity's own text in the Ministry of Commerce collection on regulated professions and activities.
- If in doubt, ask the CNRC office before signing a lease or going to the notary.
- Contact the authority named in the text (ministry, wilaya directorate, regulator) to learn the conditions: qualifications, premises, capital, guarantees, timeframes.
Approval before or after registration?
It depends on the activity's text. When the law requires the approval or licence before registration, you obtain it first and attach a copy to the CNRC file (article 4 bis of Decree No. 15-234). In other cases, you register without the licence (article 25 of Law No. 04-08 as worded in 2018, and article 4 of Decree No. 15-234), but you may not carry on the activity until the licence is issued.
| Situation | What you do |
|---|---|
| Non-regulated activity | Trade register registration, then tax, NIS and CASNOS |
| Approval required before registration | Obtain the approval, then attach a copy to the CNRC file |
| Licence required to operate | Register, then obtain the licence before starting |
| Liberal profession (doctor, lawyer, architect...) | No trade register: registration with the professional order or body |
| Auto-entrepreneur project | Not possible if the activity is regulated: trade register as a natural person or a company |
