Auto-entrepreneur or sole trader: which status to choose?

Auto-entrepreneur status fits if your activity is on the list of eligible activities and your turnover stays under 5,000,000 DA a year: you pay 0.5% of turnover (at least 10,000 DA) and can opt for a flat CASNOS contribution of 24,000 DA a year. Otherwise, you register in the trade register as a sole trader (personne physique), under the IFU flat tax (5% or 12% of turnover up to 8,000,000 DA) with CASNOS of at least 43,200 DA a year. In both cases, your personal assets answer for the business's debts.

Auto-entrepreneur and sole trader, criterion by criterion

Auto-entrepreneur status

Created by Law No. 22-23 of 18 December 2022, the status targets people working alone in an activity on the list of eligible activities. Registration is in the national auto-entrepreneur register, kept by the National Auto-Entrepreneur Agency (ANAE), which issues the auto-entrepreneur card. An auto-entrepreneur does not register in the trade register.

  • Tax: 0.5% of turnover, with a minimum of 10,000 DA a year.
  • Cap: 5,000,000 DA of turnover a year.
  • CASNOS: a flat 24,000 DA a year, if you choose it.
  • Formalities: registration with ANAE, with no articles, no notary and no capital.

The sole trader registered in the trade register

This is the classic status of the individual trader. You register in the trade register with the CNRC, then complete the tax and social security steps: NIF and declaration of existence (G n°8) within 30 days of starting, NIS from the ONS, enrolment with CASNOS. There are no articles, no notary and no capital.

  • Activities: any in the trade register's list. A regulated activity needs a licence before registration.
  • Tax: the IFU as long as turnover does not exceed 8,000,000 DA, at 5% for production and sale of goods and 12% for other activities, with a minimum of 30,000 DA. Above that, the real regime.
  • CASNOS: 15% of declared income, with a minimum of 43,200 DA a year.
  • Employees: you can hire, by registering with CNAS as an employer.

Recommendation by situation

Which legal form fits your project?

Three questions. You get a recommendation and your starting budget.

Question 1 of 3

Are you starting alone or with others?

Changing status later

A status is not final. If your business grows beyond the cap, or you change activity, you can register in the trade register as a sole trader, or set up an EURL. Plan ahead: the switch requires the full formalities of the new status.

An address for your business

A business address separate from your home is useful under both statuses. At Neuron, in Dely Brahim, domiciliation costs 6,000 DA a month, with a notarised contract of 1 year or 2 years ready within 3 days at most.

Do it yourself or get help

Both statuses are set up without a notary, and you can handle them yourself with our guides. For a sole trader, we can also fill in the 2 setup forms (trade register, G no. 8) for 2,000 DA, which you file yourself, or follow the whole file for 50,000 DA, or 40,000 DA if you are domiciled at Neuron (official fees excluded).

Frequently asked questions

What is the difference between an auto-entrepreneur and a sole trader?

An auto-entrepreneur registers with ANAE, works in an activity on the eligible list and stays under 5,000,000 DA of turnover a year. A sole trader registers in the trade register, with no cap to operate, and falls under the IFU, then the real regime.

How much does an auto-entrepreneur pay?

0.5% of turnover, with a minimum of 10,000 DA a year. For CASNOS, they can choose a flat 24,000 DA a year.

What is the auto-entrepreneur turnover cap?

5,000,000 DA a year. Above that, the status no longer fits your business.

Does an auto-entrepreneur register in the trade register?

No. They register in the national auto-entrepreneur register, kept by ANAE, which issues the auto-entrepreneur card.

How much does a sole trader pay under the IFU?

5% of turnover for production and sale of goods, 12% for other activities, with a minimum of 30,000 DA, as long as turnover does not exceed 8,000,000 DA. CASNOS comes on top: at least 43,200 DA a year.

Can an auto-entrepreneur use domiciliation?

Yes. At Neuron, in Dely Brahim, domiciliation costs 6,000 DA a month, with a notarised contract ready within 3 days at most. You only need an ID and a birth certificate extract.

Sole trader or EURL?

A sole trader costs less to set up, but your personal assets answer for debts. An EURL needs articles drawn up by a notary and about 102,700 DA in observed fees, but separates assets as a rule.
