Hiring your first employee in Algeria: contract, CNAS, contributions and income tax

To hire your first employee, sign a written employment contract (the permanent contract, or CDI, is the rule; Law No. 90-11 allows fixed-term contracts in five cases only), declare your activity as an employer to CNAS (the social insurance fund for salaried workers) and register the employee within 10 days of hiring. Then, every quarter (or every month above 10 employees), you pay CNAS 34.5% of the salary, of which 9% is withheld from pay, and you pay the income tax (IRG) withheld from the salary to the tax office with form G n°50 (or G n°50 ter if you are under the IFU flat-rate regime).

Before hiring: what CNAS will ask for

Only a business that is already registered can declare itself as an employer. To open your file, the CNAS branch asks in particular for a copy of the trade register extract (or the craft card or licence), the tax registration card (NIF), the NIS statistical number, the declaration of existence, the articles of association for a company, proof of premises and the business's bank details. If your setup is not finished, finish it first: hiring before you officially exist means employing someone you cannot declare.

Step 1: choosing the right contract

In Algeria, the contract of indefinite duration (CDI) is the rule. Law No. 90-11 of 21 April 1990 on employment relations restricts fixed-term contracts (CDD) to specific situations, and a CDD signed outside them is treated as a CDI. For a first employee in a lasting job (reception, sales, accounting, production), it is therefore almost always a CDI.

ClauseWhat to write
JobThe job title and main tasks
Place of workThe address where the employee actually works
Start date and trial periodA precise length, within the limits of the law and the collective agreement
Working timeHours and weekly working time
PayBase salary and bonuses; at least the SNMG (24,000 DA a month in 2026) for full time
LeaveThe right to annual leave, under the law and the collective agreement
Social securityThe employer's commitment to register the employee with CNAS
End of contractNotice and the termination cases provided by law
What the contract must set out clearly

Step 2: declaring yourself as an employer and registering the employee

CNAS (the National Social Insurance Fund for Salaried Workers) expects two filings. The first registers your business as an employer: the activity declaration, on form IM-03, lodged with the CNAS branch of your wilaya (province) within 10 days of your first hire. The second registers each employee: the registration request, due within 10 days of their hiring. Both can be prepared on the CNAS e-declaration portal.

Step 3: working out pay and contributions

CNAS contributions amount to 34.5% of the contribution salary: 25% paid by the employer, 9% withheld from pay and 0.5% for the social welfare fund. You withhold the employee's share from their pay and pay the whole amount to CNAS. The calculation below uses a salary of 40,000 DA as an example.

ShareRateAmountWho bears it
Employer25%10,000 DAThe business, on top of the salary
Employee9%3,600 DAWithheld from pay
Social welfare fund0.5%200 DAPaid with the contributions
Total paid to CNAS34.5%13,800 DAOf which 3,600 DA withheld from salary
Contributions on a 40,000 DA salary (example)

In this example, the gross salary after the CNAS deduction is 36,400 DA. Income tax on this salary is 2,272 DA, so the net pay is 34,128 DA. For the business, payroll costs the gross salary plus the 10,200 DA of contributions that are not withheld from pay.

Income tax on the salary

The employee's income tax (IRG, impôt sur le revenu global) is withheld at source by the employer, on the taxable salary (after the social security deduction), using the progressive scale of the Direct Taxes Code. Since the 2020 Supplementary Finance Law, taxable salaries of up to 30,000 DA a month are exempt from IRG. A first employee paid close to the SNMG (minimum wage) therefore often pays no IRG, but payroll still has to be calculated and declared correctly.

Where will your employee work?

Domiciliation gives your company a registered office address, not a workstation. As soon as someone works for you every day, they need a real place, and that is the address the contract will give as the place of work. In Dely Brahim, Neuron Cowork rents private offices: 15,000 DA a month unfurnished, 20,000 DA a month furnished, with internet, electricity, cleaning, coffee machine and printer included.

Common mistakes

  • Having someone work "on trial" without registering them with CNAS.
  • Signing a fixed-term contract for a permanent job: it will be treated as a CDI.
  • Forgetting the G n°50 ter under the IFU, because it did not apply to you before hiring.
  • Calculating income tax on the gross salary without first deducting the CNAS contribution.
  • Paying a full-time employee below the SNMG.
  • Letting the end of January pass without filing the DAS for the past year.

Frequently asked questions

Is a written contract compulsory?

Put it in writing in every case. A written contract sets the job, pay and hours, and it is the proof you will show in a dispute or an inspection. For a fixed-term contract, writing is essential: it is what shows you are in one of the five cases allowed by Law No. 90-11.

How much does an employee paid 40,000 DA cost?

On the CNAS side, 13,800 DA a month in total (34.5%). Of this, 3,600 DA is withheld from the salary; the remaining 10,200 DA comes on top of the gross salary and is paid by the business. Income tax, if due, is withheld from the employee's salary.

Will my employee pay income tax?

Not if their taxable salary, after the CNAS deduction, is 30,000 DA a month or less: it has been exempt since the 2020 Supplementary Finance Law. Above that, the tax follows the progressive scale and you withhold it from their pay.

What happens if I register my employee late?

CNAS may register them automatically, in particular after an inspection, and late-payment penalties apply. If the 10-day deadline has already passed, put it right without waiting.

Does the manager of my SARL count as an employee?

It depends on their shares. A majority partner-manager and the sole partner of an EURL pay into CASNOS. A minority or non-partner manager paid by the company is registered with CNAS, like an employee.

Can I hire if my company is domiciled?

Yes: the domiciliation address is your registered office, and CNAS generally accepts it as proof; check with the branch. Your employee, however, needs a real workstation at the address given in their contract.

Are there reductions on contributions?

Yes, in some cases, for example when hiring jobseekers or people with disabilities. The reduction applies to the employer's share and is requested from CNAS with the dedicated form.

Can Neuron handle these formalities?

No. Neuron only fills in business setup forms and does not do bookkeeping or routine returns: this guide is free and all you need to do it yourself.
